Terms & Conditions

The Company
Tropica Corporation Limited (trading as Tropica Island Resort) is a limited liability company registered in the Republic of Fiji. For the purposes of these terms and conditions will be referred to as “The Resort”. By making a reservation with the Resort, making payment toward a reservation and/or checking in, guests acknowledge and agree to be bound by these Terms & Conditions.
 
Check-In & Check-Out Times
  • Check-In is at 2.00pm (1400 hours).
  • Check Out is at 10.00am (1000 hours).
  • Late checkout is available on request and subject to availability.
  • A guaranteed late check out will be charged at one nights’ full rate.
  • Guests are required to present valid photographic identification upon check-in, together with a valid credit card. The name displayed on the credit card must exactly match the name shown on the photographic identification and be in the name of the registered guest.
Deposits & Payments
  • Full payment is required 30 days prior to the scheduled arrival date.
  • Full payment is required if booking is made within 30 days of arrival date.
  • Tropica is a cashless resort and does not accept cash payment.
  • All outstanding accommodation charges, transfers, food and beverage, spa treatments, activities, incidentals and other charges incurred during the stay must be settled in full prior to departure.
Cancellation Policy
  • Cancellations made within 30 days of the scheduled arrival date will incur a cancellation fee equal to 100% of the total booking cost
  • No Shows or failure to arrive will incur a fee equal to 100% of the total booking cost.
  • The Resort must receive all cancellations in writing.
  • Unused accommodation nights, services or inclusions resulting from late arrival, delayed travel, early departure or a guest’s decision not to use the services booked are non-refundable.
  • Guests are strongly encouraged to obtain comprehensive travel insurance to protect against unforeseen circumstances that may result in cancellation or disruption to their travel plans.
Credit Card Payments
  • Credit card payments incur a non-refundable 3.2% Fiji transaction levy for Visa and Mastercard, and 4.9% for Amex.
  • Credit card refunds will incur a non-refundable 3.2% surcharge for Visa and Mastercard, and 4.9% for Amex.
  • By confirming a reservation and providing valid credit card details, the guest authorises Tropica Island Resort to process payments that have been expressly agreed or otherwise authorised in connection with the reservation, including accommodation, transfers and other pre-arranged services, in accordance with the Resort’s booking and cancellation policies.
  • Guests will be required to present the physical credit card initially used for payment, together with valid photographic identification, upon check-in.
  • The Resort reserves the right to require an alternative method of payment where the name on the payment card does not match the name of the registered guest or where the Resort has reasonable concerns regarding the validity or security of a payment.
Pre-Authorisation & Incidental Charges
 
  • Upon check-in, the Resort may place a pre-authorisation on the credit card to cover anticipated incidental charges incurred during the guest’s stay.
  • The amount of any pre-authorisation will be advised at check-in and may vary depending on the length of stay or other relevant circumstances.
  • A pre-authorisation is not a payment but may temporarily reduce the available balance or credit limit on the guest’s card. Following settlement of the final account, the release of any unused pre-authorised amount is subject to the processing times and policies of the guest’s financial institution. The Resort has no control over the time taken by a financial institution to release these funds.
  • All outstanding charges must be settled in full prior to departure.
Bank Transfer
  • Payments made by international bank transfer will incur an additional FJ$30 fee to cover bank processing costs. This amount will be added to the reservation and is payable upon check-out.
  • Charges imposed by sending, intermediary or receiving banks may vary depending on the financial institutions involved in processing the transfer.
  • Guests are responsible for ensuring that the Resort receives the full invoiced amount.
  • Where the amount received is less than the invoiced amount due to bank fees, currency conversion costs or other deductions, the outstanding balance will be added to the guest’s reservation and will be payable prior to or upon check-out.

Smoking & Vaping Policy

  • All guest rooms and indoor Resort areas are strictly non-smoking.
  • Smoking and vaping are permitted only in areas designated by the Resort.
  • Guests who smoke or vape in a non-smoking area or guest room may be responsible for the reasonable costs of additional or specialist cleaning, deodorising or remediation required as a result.
  • Where a guest room is unable to be occupied due to smoking-related cleaning or remediation, the Resort reserves the right to seek recovery of reasonable and demonstrable losses directly resulting from the room being temporarily unavailable.
Alcohol
  • Only alcoholic beverages purchased from Resort outlets may be consumed in the Resort’s bars, restaurants and poolside areas.
  • Duty-free wine and spirits brought to the Resort by guests may be consumed in the privacy of the guest’s room.
  • Cases or bulk quantities of beer, wine or other alcoholic beverages may not be brought onto the Resort. Any such items may be securely held by the Resort and returned to the guest upon check-out.
  • The Resort reserves the right to refuse the service of alcohol to any person who is intoxicated, behaving inappropriately or where the service of alcohol would otherwise be contrary to applicable law or responsible service practices.
Guest Conduct
  • Guests are expected to conduct themselves in a manner that respects the safety, privacy, comfort and enjoyment of other guests, Resort employees and visitors.
  • The Resort will not tolerate abusive, threatening, intimidating, discriminatory, violent, illegal or seriously disruptive behaviour.
  • Guests must comply with reasonable directions provided by Resort Management and employees in relation to safety, security, responsible service of alcohol, use of Resort facilities and the comfort and wellbeing of others.
  • The Resort reserves the right, subject to applicable law, to refuse service or require a guest to leave the Resort where the guest’s behaviour presents a safety or security risk, involves illegal activity, causes deliberate or serious damage to property, or materially interferes with the safety, privacy or peaceful enjoyment of other guests or Resort employees.
  • In serious circumstances, the Resort may contact the appropriate authorities.
  • Any refund in such circumstances will be determined in accordance with applicable law and the circumstances of the incident.
Guest Responsibility & Damage to Resort Property
  • Guests are responsible for treating all Resort property, facilities, furnishings and equipment with reasonable care throughout their stay.
  • The registered guest accepts responsibility for any loss, damage, breakage, staining or excessive soiling of Resort property caused by the guest or any person associated with or visiting the guest during their stay, excluding reasonable wear and tear.
  • This includes, but is not limited to, damage to or loss of furniture, furnishings, bedding, linen, towels, mattresses, flooring, walls, doors, windows, fixtures, fittings, artwork, electrical equipment, appliances, outdoor furniture, pool equipment and any other property belonging to the Resort.
  • Where additional or specialist cleaning is required beyond the Resort’s normal housekeeping procedures, the guest will be responsible for the reasonable costs incurred. This includes professional cleaning or treatment required as a result of stains, spills, bodily fluids, food or beverage damage, smoking, vaping, or other excessive soiling of furniture, upholstery, mattresses, bedding, carpets, rugs, curtains or other Resort property.
  • Where an item cannot reasonably be cleaned or repaired, the guest may be responsible for the reasonable cost of replacing the damaged item.
  • Where damage caused by a guest renders a guest room or Resort facility temporarily unavailable for use, the Resort reserves the right to seek recovery of reasonable and demonstrable losses directly resulting from the damage, including necessary repair or replacement costs and, where applicable, loss of accommodation revenue.
  • The Resort reserves the right to charge an authorised payment method provided by the guest, where permitted, or otherwise seek payment from the guest for reasonable costs arising from such loss, damage, repair, replacement or specialist cleaning.
  • Where practicable, the Resort will retain appropriate records or supporting documentation of the damage and associated costs.
  • Guests are requested to report any damage, breakage or maintenance issue to Resort Management as soon as reasonably possible.
Child Policy
  • Tropica Island Resort is an adults-exclusive resort and does not accept guests under the age of 16 years.
Travel Insurance
  • The Resort strongly recommends that all guests obtain comprehensive travel insurance appropriate to their individual circumstances and for the entire duration of their travel.
  • Travel insurance should provide appropriate protection for circumstances including, but not limited to, cancellation fees, illness or injury, medical expenses, travel delays, missed or cancelled flights and transfers, adverse weather, cyclones and other unforeseen disruptions.
  • The Resort’s cancellation policy will apply regardless of whether a guest has obtained travel insurance.
Resort Activities & Equipment
  • Participation in Resort activities is undertaken at the guest’s own risk, subject to any rights that cannot lawfully be excluded.
  • Guests are responsible for following all reasonable safety instructions provided by Resort employees, guides and activity operators.
  • The Resort reserves the right to restrict or cancel an activity due to weather conditions, safety concerns, equipment availability or other circumstances that may affect the safe operation of the activity.
  • Guests may be held responsible for the reasonable repair or replacement cost of Resort equipment that is lost or damaged as a result of deliberate, reckless or negligent conduct.
Pre-Booked Activity Cancellation Policy
  • For all pre-booked activities, cancellations made within 24 hours of the scheduled activity will incur a charge equal to 50% of the activity cost.
  • No-shows will be charged the full cost of the activity.
  • On occasion, the Resort may be required to change or cancel activity dates or times due to circumstances including adverse weather, sea conditions, safety considerations, boat availability or other unforeseen circumstances.
Third-Party Suppliers
  • The Resort may, from time to time, arrange bookings on behalf of guests with independent third-party suppliers for services including, but not limited to, sea and air transfers, fishing, diving, surfing, yacht charters, water taxis, tours and other activities.
  • Where the Resort acts solely as a booking agent for an independent third-party supplier, the services are provided by that supplier and may be subject to the supplier’s own terms and conditions.
  • To the extent permitted by law, the Resort accepts no liability for the acts, omissions, delays, cancellations or service failures of independent third-party suppliers, or for loss, damage or injury arising from services independently provided by those suppliers.
  • Nothing in these Terms & Conditions excludes any rights or remedies that cannot lawfully be excluded.
Drone Policy
  • To protect the safety, security and privacy of our guests, Tropica Island Resort prohibits the unauthorised operation or use of unmanned aerial systems or drones within or above the Resort and its immediate surroundings where such operation may affect Resort guests, employees, facilities or operations.
  • This includes drones operated by private individuals, commercial operators or media organisations for photography, filming, weddings, journalism, live streaming or other purposes.
  • The launching, landing or operation of a drone from Resort property is prohibited without prior written approval from Resort Management.
  • Any approved drone operation must comply with all applicable Fiji aviation laws, regulations and requirements and must respect the privacy of Resort guests and employees. Resort Management may impose restrictions on approved drone operations, including designated locations and operating times.
  • The Resort reserves the right to withdraw permission for drone operations at any time where safety, privacy, security or guest comfort may be affected.
  • Unauthorised drone use may result in the guest being directed to immediately cease operation of the device and may expose the operator to liability under applicable law.
Privacy & Photography
  • Guests are expected to respect the privacy of other guests and Resort employees.
  • Photography or filming that unreasonably interferes with another person’s privacy is not permitted.
  • Commercial photography, professional filming, media production or photography intended primarily for commercial publication or promotion requires prior written approval from Resort Management.
Renovations, Repairs & Maintenance
  • In its discretion, the Resort reserves the right from time to time to close, restrict access to or carry out repairs, maintenance, renovations or upgrades to any part of its facilities where reasonably necessary.
  • The Resort will endeavour to minimise unreasonable disruption to guests where practicable.
Prices
  • All prices are subject to change, and the Resort reserves the right to amend advertised prices, packages and inclusions at any time prior to confirmation of a reservation.
  • Once a reservation has been confirmed, the rates and inclusions applicable to that confirmed reservation will apply, subject to any errors, omissions, changes in government taxes or levies, or other circumstances permitted by applicable law.
Resort Credits
  • Resort Credits may be applied only toward eligible food and beverage purchases, spa treatments and Resort-owned and operated activities unless otherwise stated in the applicable offer.
  • Resort Credits cannot be applied toward accommodation charges, return island transfers or services provided by external or third-party operators.
  • Any unused Resort Credit remaining at the conclusion of the stay is non-refundable, non-transferable and cannot be redeemed for cash.
  • Unless expressly stated otherwise, Resort Credits apply to new bookings only and may not be combined with another special offer, with the exception of the Honeymoon Bonus where applicable.
Travel Advisory
  • Guests are strongly advised to obtain current travel information from their relevant Consulate, Embassy, Government travel advisory service or other appropriate authority if they have concerns regarding travel to Fiji.
  • It is the responsibility of each guest to ensure that they hold all required passports, visas, permits and other travel documentation necessary to enter and travel within Fiji
Force Majeure (Conditions beyond our control)
  • The Resort will not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond the Resort’s reasonable control.
  • Such circumstances may include, but are not limited to, acts of God; fire; flood; earthquake; explosion; storm; cyclone or other natural disaster; changes in law or government action; war or hostilities, whether declared or not; terrorism or threats of terrorism; civil unrest or disorder; labour strikes or industrial action; transportation disruption; interruption to essential services; seizure or compulsory acquisition under legal process; disease; epidemic; pandemic; public health emergency; or other events beyond the Resort’s reasonable control.
  • Where a force majeure event affects the Resort’s ability to provide accommodation or services, the Resort will endeavour to communicate with affected guests and manage the circumstances reasonably, having regard to guest safety and operational conditions.
Personal Property & Valuables
  • Guests are responsible for taking reasonable care of their personal property and valuables during their stay.
  • Guests are encouraged to use any in-room safe or other secure storage facilities provided by the Resort for passports, cash, jewellery and other valuable items.
  • To the extent permitted by applicable law, the Resort accepts no responsibility for the loss, theft or damage of personal property unless such loss, theft or damage results from circumstances for which the Resort is legally liable.
  • Guests should promptly report lost, stolen or damaged property to Resort Management.
Responsibility & Limitation of Liability
  • To the fullest extent permitted by applicable law, the Resort will not be responsible for loss, damage, injury, delay, inconvenience or additional expense resulting from circumstances beyond the Resort’s reasonable control.
  • Such circumstances may include, but are not limited to, transportation delays, airline or transfer cancellations, adverse weather, cyclones, natural disasters, civil disturbance, government action, pandemics, interruptions to utilities, mechanical or equipment failures, or errors or omissions by independent travel agents or third-party service providers.
  • Nothing in these Terms & Conditions is intended to exclude, restrict or modify any liability, right or remedy that cannot lawfully be excluded, restricted or modified under the laws of the Republic of Fiji.
Feedback & Complaint Resolution
  • The comfort and satisfaction of our guests are of great importance to the Resort. Guests are encouraged to bring any concern, issue, complaint or specific request to the attention of Resort Management as soon as reasonably possible during their stay.
  • Prompt notification provides the Resort with an opportunity to investigate the matter and, where reasonably possible, take appropriate steps to address or remedy the issue while the guest remains at the Resort.
  • Where a guest does not notify Resort Management of an issue during their stay, the Resort may not have a reasonable opportunity to investigate or remedy the matter at the time.
  • Any unresolved complaint or claim should be submitted to the Resort in writing with sufficient information to allow the Resort to investigate and respond appropriately.
Acceptance of Terms & Conditions
  • By completing a reservation with Tropica Island Resort, making payment toward a reservation and/or checking in at the Resort, the guest acknowledges and agrees to these Terms & Conditions.
  • Where a reservation is made on behalf of multiple guests, the person making the reservation is responsible for ensuring that all guests included in the reservation are made aware of these Terms & Conditions.
  • Where a reservation is made through a travel agent, wholesaler, online travel agency or other third party, additional terms and conditions imposed by that party may also apply.
Governing Law
  • These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Fiji.
  • Any dispute, controversy, proceeding or claim arising out of or in connection with these Terms & Conditions or the provision of Resort services, including any non-contractual dispute or claim, will be subject to the jurisdiction of the appropriate courts of the Republic of Fiji.
